This document comprises the Terms of Use Agreement, hereinafter referred to as the “Agreement”, and constitutes a legally binding Agreement between you, (“You”) the visitor or member of our site, hereinafter referred to as the SiteGrouper.com.
As a condition precedent to you being able to use any of the tools, functions and services provided to you by this site, you must read and agree to be bound by each and every one of the terms and conditions contained in this Agreement. Should you access any component of this site, or use any tools, functions or services that this site offers, register as a member, or view any text or graphics, such activities on your part means expressly that you have read this Agreement and agree to be bound by the terms and conditions contained herein. Should you not agree to be bound by each and every term and condition contained in this Agreement you must leave this Site at once and you may not establish a membership.
By using and/or participating in the SiteGrouper.com program, you acknowledge that you have read, understood and agreed to be bound by the terms and conditions of this Agreement (as amended from time to time by SiteGrouper.com in its sole and absolute discretion).
I understand that all members are automatically opted-in at sign-up for announcements via email. SiteGrouper.com reserves the right to contact any member for the purpose of making announcements that will inform subscribers of training videos, resources, tips, instructions and other important notifications regarding the status of SiteGrouper.com.
I understand that SiteGrouper.com reserves the right to change or modify the terms of this Agreement or deny services to anyone, without notice, for any reason, including but not limited to any unusual use of bandwidth and/or spamming.
I understand that I am responsible for providing SiteGrouper.com with accurate contact and payment information at all times. SiteGrouper.com is not responsible for service interruptions that may result from my payment information becoming out of date.
I authorize SiteGrouper.com to charge the credit card listed in my online application form for SiteGrouper.com services provided on a recurring monthly basis, and for any past due balances in order to bring the account balance current. I understand that credit card payments shall be billed and charged automatically. SiteGrouper.com may charge my credit card account at any time for any outstanding invoice.
I understand that if payment has not been received within 7 calendar days of our attempting to charge your designated credit card account your domains will be removed and made inactive.
I agree that all domains will be deleted from an inactive account within 90 days or when my account is terminated by either party. If I choose to use SiteGrouper.com service again thereafter, I must sign up for a new account.
I understand that activating fewer than 5 domains will still result in my credit card being charged the required 5 domain minimum.
I agree that SiteGrouper.com shall have the right to suspend my account at any time for any reason without any prior notice. If service is to be suspended for more than 15 days, I will be notified in advance as to the reason.
I understand that I may cancel my SiteGrouper.com account at any time.
I understand that SiteGrouper.com reserves the right to change the membership rates and charges by notifying me 30 days in advance of the effective date of the change.
I understand that if I am dissatisfied with the service or with any terms, conditions, rules, policies, practices or guidelines of SiteGrouper.com in providing the service, I understand that my sole and exclusive remedy is to discontinue using the Service.
I understand that all visual or text content I have created, listed, and published while a SiteGrouper.com subscriber is subject to copyright, trademark or other laws regarding intellectual property ownership. It is my sole responsibility to abide by all such laws with regard to publishing visual or any other forms of content. I will hold SiteGrouper.com, its affiliates, agents, partners, employees, contractors, and owners completely harmless and not liable for any copyright, trademark or intellectual property infringements that may arise from my violation of the Copyright Laws.
I understand that SiteGrouper.com reserves the right to terminate services provided to you for any reason we deem appropriate. I further understand that my SiteGrouper.com account can be terminated at any time for any misconduct or violations of State and Federal Laws. Such misconduct or violations are not limited to copyright or trademark infringement, intellectual property theft, libel, slander, defamation, pornographic use, explicit sexual or vulgar content, broadcasting derogatory threats, verbal or otherwise, to the SiteGrouper.com service personnel or staff. I will hold SiteGrouper.com, its affiliates, agents, partners, and owners completely harmless and not liable for any misconduct or violation of State and Federal Laws that I have committed or perpetrated as an SiteGrouper.com subscriber.

You must be of adult age in your jurisdiction to use this site or the tools and services that we provide. In any event, no user or member may be under the age of 18 years of age. Parents or guardians of minors may enroll as a service member on behalf of their minor children/wards but are solely responsible for the direct supervision of their children/wards while their minors visit the site or use any of the tools or services that the site provides.
We may post rules, guidelines or policies. Upon the posting of such materials, they immediately become incorporated by reference into this Agreement as if fully set forth herein.

At SiteGrouper.com .com, you are asked to provide personal information, such as your e-mail address, name, home or work address or telephone number. When you sign up for the SiteGrouper.com paid subscription service, you will be asked for additional information, such as your credit card number and billing address that is used to create a SiteGrouper.com billing account.
In order to access SiteGrouper.com features and services, you will be asked to sign in with username and password, which is referred to as your “login data.” As part of creating your login data, you may also be requested to provide questions and secret answers, which SiteGrouper.com uses to help verify your identity and assist in resetting your password, as well as an alternate email address.
SiteGrouper.com uses your personal information to communicate with you. It may send certain mandatory service communications such as welcome letters, FREE 3 Day Trial reminders, billing reminders, information on technical service issues, and security announcements. It may also occasionally send you product surveys or promotional mailings to inform you of other products or services available from SiteGrouper.com and its affiliates.
Except as described in this statement, your personal information will not be disclosed outside of SiteGrouper.com and its controlling entities and affiliates without your consent.
SiteGrouper.com and its controlling entities may access and/or disclose your personal information if such action is believed to be necessary to: (a) comply with the law or legal process served on SiteGrouper.com; (b) protect and defend the rights or property of SiteGrouper.com (including the enforcement of our agreements); or (c) act in urgent circumstances to protect the personal safety of users of SiteGrouper.com services or members of the public.
